    Once a person/defendant has been formally arrested and charged, it is rather difficult to have the case just “dropped.” After arrest, the State’s Attorney’s Office for the particular county in which the offense occurred is the only party that has the discretion as to whether to dismiss a case or not. Most counties/jurisdictions have “no-drop” policies – which means the State’s Attorney’s Office will not “drop” (dismiss) a case once the offender has been officially charged. However, according to the Victim’s Bill of Rights, a victim has a right to be heard by the State’s Attorney’s Office. And, any victim can express their wishes to the State’s Attorney’s Office. Additionally, most jurisdictions merely have the case set for trial. In the event that the there is no personal service of a criminal subpoena on the victim to appear in court or the victim does not otherwise appear on the scheduled trial date, the case may be dismissed.
